Questionnaire Terms of Use

This document contains the rules for using the Questionnaire at parkerkerrigan.co.uk (the ‘Questionnaire’). By accessing and/or using any part of the Questionnaire you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms, you must not use the Questionnaire.

Status of the Questionnaire and associated documents

The Questionnaire and any documents available in it or otherwise associated are:

  1. confidential to Parker Kerrigan trading as Harcus Parker Limited (the ‘Solicitors’). They contain the Solicitors' work product and know-how, and are commercially sensitive;
  2. privileged as between the Solicitors, their clients and potential clients; and
  3. only made available for the purposes of allowing potential clients of the Solicitors to evaluate whether they wish to:
    1. a) make a complaint against their motor finance lender(s) regarding the use of discretionary commission arrangements; the payment of high commissions, defined as commissions which are equal to or greater than 39% of the total charge for credit and 10% of the credit amount; and contractual ties that gave the lender exclusivity or a right of first refusal (‘the Claim’); and
    2. b) notwithstanding that the Financial Conduct Authority (FCA) has made available a scheme that will be free of charge, use the services of a law firm.
  4. If you do not in good faith believe that you are eligible to make a Claim, then you must not continue with the Questionnaire.

Your confirmations when using the Questionnaire

By accessing and/or using the Questionnaire, you agree and confirm that you:

  1. were unaware of the charges you incurred on your motor finance agreement because of undisclosed commission / level of commission that was being paid by the Finance Provider to the Dealer/Broker;
  2. in respect of a possible Claim, you have not instructed a law firm, claims management company ('CMC') or made one yourself. If you have done so, by completing this Questionnaire, you agree that you will cancel any other claims with any other law firm or CMC;
  3. have not received any damages or compensation for this type of Claim, whether in cash or in kind, including receipt of a full refund for any commission payable under a motor finance agreement between 6 April 2007 and 1 November 2024;
  4. that you have not filed proceedings in a Court or Tribunal, including with the Financial Ombudsman Service similar to the Claim and lost those proceedings, or those proceedings are ongoing;
  5. have not settled a diesel emissions claim in respect of the vehicle to which the motor finance agreement relates;
  6. are domiciled in the United Kingdom;
  7. are not a director, principal, or employee of a CMC;
  8. do not act as a solicitor, work for a firm of solicitors, or a CMC acting (or intending to act) for other claimants or defendants in any claim similar to the Claim; are not a current director, employee, or associate of any employee of a company that was in the business of providing finance for motor vehicles between 2007 and 2024, nor are you a member of a legal team that has been instructed by a motor finance company in the defence of the Claim, and you do not intend to pass on any information about the sign-up process to them or any other person or entity with an interest adverse to the claim; and
  9. do not have any bankruptcy or insolvency proceedings directly impacting you and/or any settlement you may be awarded
